AWS Marketplace End User License Agreement

This End User License Agreement ("EULA") is a binding agreement between three.ws ("we", "us", "our") and the individual or entity ("you", "Customer") that subscribes to, accesses, or uses the three.ws product offered through AWS Marketplace (the "Product"). By subscribing to or using the Product, you agree to this EULA. If you do not agree, do not subscribe to or use the Product.

1. Relationship to AWS

The Product is made available through AWS Marketplace, operated by Amazon Web Services, Inc. and its affiliates ("AWS"). AWS is not a party to this EULA and is not responsible for the Product. Your procurement of the Product is also subject to the AWS Customer Agreement and the AWS Marketplace terms. This EULA governs your use of the Product itself.

2. License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Product for your internal business purposes during the term of your subscription. We reserve all rights not expressly granted.

3. No Fees; Free Offering

The Product is currently offered free of charge through AWS Marketplace. No subscription fees, usage fees, or other charges are payable to us for the Product, and accordingly no refunds apply. Because the Product is provided at no cost, you acknowledge that you are receiving it without payment and bear all risk of its use.

We may, at our sole discretion and with prior notice through AWS Marketplace, introduce fees, change pricing, or discontinue the free offering for new or renewing subscriptions. Continued use after such a change becomes effective constitutes acceptance of it.

4. No Service Levels; Availability

The Product is provided without any service-level agreement, uptime commitment, or guaranteed support. We may modify, suspend, throttle, or discontinue the Product, in whole or in part, at any time and without liability. We provide support, if any, on a best-effort basis only and are under no obligation to do so.

5. Acceptable Use

You agree not to:

• Use the Product in violation of any applicable law, regulation, or third-party right.
• Transmit malware, attempt to gain unauthorized access to, or interfere with the Product or its infrastructure.
• Reverse-engineer, decompile, or disassemble any part of the Product except to the extent permitted by law.
• Resell, sublicense, or otherwise commercially exploit the Product beyond what is expressly permitted.
• Use the Product to build a competing product or to circumvent usage limits or access controls.
• Exceed any rate limits or use automated means to overload the Product.

We may suspend or terminate your access immediately for any breach of this Section, without notice and without liability.

6. Blockchain & Digital Asset Disclaimer

The Product may interact with public blockchains and digital assets. You acknowledge that on-chain transactions, registrations, and identities (including ERC-8004 records and Metaplex NFTs) are immutable and cannot be reversed, altered, or deleted by us. You are solely responsible for any wallet keys, gas fees, network selection, and on-chain actions. We do not custody your assets and provide no financial, investment, legal, or tax advice. Blockchain networks carry inherent technical, market, and regulatory risks that we do not control and for which we are not responsible.

7. Customer Data & Privacy

You are responsible for the content and data you submit to the Product and represent that you have all rights necessary to do so. Our handling of personal data is described in our Privacy Policy. You are responsible for complying with all laws applicable to your use of the Product and your data.

8. Intellectual Property

We and our licensors retain all right, title, and interest in and to the Product, including all related intellectual property. No ownership rights are transferred to you under this EULA. Feedback you provide may be used by us without restriction or obligation to you.

9. Disclaimer of Warranties

THE PRODUCT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PRODUCT WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA WILL BE ACCURATE OR PRESERVED. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE PRODUCT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THREE.WS OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, DIGITAL ASSETS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THE PRODUCT OR THIS EULA, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE THE PRODUCT IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE PRODUCT AND THIS EULA WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless three.ws and its officers, directors, employees, and agents from any claims, liabilities, damages, judgments, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Product, your data, or your violation of this EULA or any applicable law or third-party right.

12. Term & Termination

This EULA applies for as long as you access or use the Product. You may stop using the Product and unsubscribe through AWS Marketplace at any time. We may suspend or terminate your access at any time, with or without cause, and without liability. Upon termination, the license in Section 2 ends and you must cease all use of the Product. Sections 6 through 11 and 13 survive termination.

13. Export & Compliance

You represent that you are not located in, and will not use the Product in, any country or by any party subject to U.S. or other applicable sanctions or export restrictions, and that you will comply with all applicable export-control and sanctions laws.

14. Governing Law

This EULA is governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

15. Entire Agreement

This EULA, together with the three.ws Terms of Service and Privacy Policy (incorporated by reference), is the entire agreement between you and us regarding the Product and supersedes any prior agreements on that subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of it.
